Answers: 1.One of the landmark decisions given by the High Court was the case of Kartinyeri v Commonwealth[1] where section 51(xxvi) of the Constitution was interpreted. The case in hand was related to the applicability of this particular section over the Indigenous population in Australia. Under section 51 (xxvi) of the Australian Constitution, the matter which relate to people of one or any race, can be legislated by the Parliament, except for the people who belong to Aboriginal race, irrespective of the state in which they reside. And under this very section, it is mandatory to create special laws for the aboriginal people. Through the insertion of this section in the constitution of Australia, the discrimination against a specific section of the community has been allowed, particularly on the basis of the race of such people[2]. In Kartinyeri v Commonwealth, the minister held the power of making declarations for the purpose of protecting the areas of Aboriginals. A claim was made by a group containing women regarding the use of island for womens secret business, and that this business could not be divulged to men. The minister was permitted to put forward his recommendations, only after a woman was given the responsibility of carrying out the enquiry. However, this enquiry had different problems which led to the passing of a legislature by the government for going forward with the bridge and even though there were an objection by the Aboriginals, the go ahead was given. The major point which was raised through this case was the power of the commonwealth to pass an act under its race power, which in reality was detrimental for people belonging to a particular race group.[3] The decision of the case was not decided due to the division in the decision of the jury. In the view of Hayne and Gummow, such an act could be undertaken without any issues. The reason for this was due to the fact that there was no restriction on power being used for non-detrimental or detrimental purposes, so it could be used for benefit or disadvantage of the particular race. They held that the need for the power to be valid only upon being used for the benefit of people belonging to Aboriginal race was wrong and so, they rejected this notion. They also stated that the constitution did not require the law to distinguish between the needs and responsibilities of different race people. Hayne and Gummow suggested that the limit which had been placed through the quoted section was on the basis of what is deemed necessary[4]. The legislation was not limited through section 51(xxvi) regarding its application on people belonging to a particular race[5]. Some of the arguments were rejected by Hayne and Gummow. The interpretation of 1997 act was one of the arguments rejected by them regarding the same to be consistent with the standards set regarding human rights based on the international laws. The argument pertaining to the 1967 referendum where it was asked to drawn the limitations from this referendum, were also rejected by them[6]. As highlighted earlier, the views of the judges was not unanimous. Kirby JJ and Gaudron were of the view that the power was not being used for the proper purpose as the same proved to be of detriment to the racial minority. Hence, in their view, the legislation was not valid. And they did put forward the suggestion of the limitations on the basis of section 51(xxvi)[7]. It was the view of Kirby that there was need under the law to direct the members of a particular race; however, there was still a need to deal in a valid manner with the subgroups. McHugh and Brennan were the remaining two judges of this case who did not take into consideration the scope of the power. A decision regarding the constitutions quoted section being subjected to these limitations was not undertaken by them. The interpretative principle discussed earlier was reaffirmed by the court. The crux of this case and the guidance which it offers for similar situations is that where the constitution is ambiguous, the universal basic rights have to be complied with[8]. 2.A successful referendum would make way for changes to be brought to the Australian Constitution. Through this, there would be an establishment of the First nations Voice of the Aboriginal and Torres Strait Islanders who would be given the responsibility of advising the Parliament in all such issues which relate to making of law in the areas which touch the Indigenous people, and which have been covered under the Final Report of the Referendum Council and the Uluru Statement from the Heart. This would result in a key change being made to the way in which the section 51 (xxvi) would be interpreted, which right now, is applicable in the nation. The key difference which would be made owing to this would be a unanimous decision being attained in the matter of Kartinyeri v Commonwealth. The First Voice could clearly present before the Australian High Court that the powers which have been given pursuant to the quoted section, could not be used in a manner which proves to be a disadvantage for the Aboriginals. This is due to the fact that the First Voice would be able to highlight the need for conforming with the international human rights, which relate to the Aboriginals. So the cases like Kartinyeri v Commonwealth, would become decisive and would also provide the required backing to the ideas presented by Kirby JJ and Gaudron, who also supported the notion that the powers under the quoted section could not be used in a manner which proves to be detrimental for the Aboriginals. The scope for protection of other races, apart from the Aboriginals, could also be enhanced through this action. English Henry David Thoreau The Great Conservationist, Visionary, and Humanist He spent his life in voluntary poverty, enthralled by the study of nature. Two years, in the prime of his life, were spent living in a shack in the woods near a pond. Who would choose a life like this? Henry David Thoreau did, and he enjoyed it. Who was Henry David Thoreau, what did he do, and what did others think of his work? Henry David Thoreau was born in Concord, Massachusetts on July 12, 1817 ("Thoreau" 96), on his grandmother's farm. Thoreau, who was of French-Huguenot and Scottish-Quaker ancestry, was baptized as David Henry Thoreau, but at the age of twenty he legally changed his name to Henry David. Thoreau was raised with his older sister Helen, older brother John, and younger sister Sophia (Derleth 1) in genteel poverty (The 1995 Grolier Multimedia Encyclopedia 1). It quickly became evident that Thoreau was interested in literature and writing. At a young age he began to show interest writing, and he wrote his first essay, "The Seasons," at the tender age of ten, while attending Concord Academy (Derleth 4). In 1833, at the age of sixteen, Henry David was accepted to Harvard University, but his parents could not afford the cost of tuition so his sister, Helen, who had begun to teach, and his aunts offered to help. With the assistance of his family and the beneficiary funds of Harvard he went to Cambridge in August 1833 and entered Harvard on September first. "He [Thoreau] stood close to the top of his class, but he went his own way too much to reach the top" (5). In December 1835, Thoreau decided to leave Harvard and attempt to earn a living by teaching, but that only lasted about a month and a half (8). He returned to college in the fall of 1836 and graduated on August 16, 1837 (12). Thoreau's years at Harvard University gave him one great gift, an introduction to the world of books. Upon his return from college, Thoreau's family found him to be less likely to accept opinions as facts, more argumentative, and inordinately prone to shock people with his own independent and unconventional opinions. During this time he discovered his secret desire to be a poet (Derleth 14), but most of all he wanted to live with freedom to think and act as he wished. Immediately after graduation from Harvard, Henry David applied for a teaching position at the public school in Concord and was accepted. However, he refused to flog children as punishment. He opted instead to deliver moral lectures. This was looked down upon by the community, and a committee was asked to review the situation. They decided that the lectures were not ample punishment, so they ordered Thoreau to flog recalcitrant students. With utter contempt he lined up six children after school that day, flogged them, and handed in his resignation, because he felt that physical punishment should have no part in education (Derleth 15). In 1837 Henry David began to write his Journal (16). It started out as a literary notebook, but later developed into a work of art. In it Thoreau record his thoughts and discoveries about nature (The 1995 Grolier Multimedia Encyclopedia 1). Later that same year, his sister, Helen, introduced him to Lucy Jackson Brown, who just happened to be Ralph Waldo Emerson's sister-in-law. She read his Journal, and seeing many of the same thoughts as Emerson himself had expressed, she told Emerson of Thoreau. Emerson asked that Thoreau be brought to his home for a meeting, and they quickly became friends (Derleth 18). On April 11, 1838, not long after their first meeting Thoreau, with Emerson's help, delivered his first lecture, "Society" (21). Ralph Waldo Emerson was probably the single most portentous person in Henry David Thoreau's life. From 1841 to 1843 and again between 1847 and 1848 Thoreau lived as a member of Emerson's household, and during this time he came to know Bronson Alcott, Margaret Fuller, and many other members of the "Transcendental Club" ("Thoreau" 696). On August 31, 1839 Henry David and his elder brother, John, left Concord on a boat trip down the Concord River, onto the Middlesex Canal, into the Merrimack River and into the state of New Hampshire. Out of this trip came Thoreau's first book, A Week on the Concord and Merrimack Rivers (25). Equally, Mrs. Wright seems to live an oppressed life under the dominance of her husband. She gets excited after her husband’s death and acts in a way that suggests she might have exterminated her husband’s life. Both women were shunned by the society as they were perceived to be acti ng against the norms. They were rarely visited and other women did not cooperate with them. They lived in a disaffected world where repression was tolerated and any actions aimed at challenging male supremacy were deemed belligerent. Somewhat, both women are victims and equally victors. Mrs. Wright is under probation after being suspected of killing her husband. On the other hand, Mrs. Mallard surrenders to heart attack after the realization that her husband was alive. However, Mrs. Wright becomes a victor by managing to terminate the life of a man who oppressed her while Mrs. Mallard surrenders her life to call for humanitarian agencies to intervene and stop the oppression that women were undergoing. Evidently, the women spearheaded what is currently known as ‘women emancipation’ aimed at upholding women’s right and call for equality in a fairly just world. There would be other personnel who would guard the windows during this time. 5 of the security would be located all over the estate and home at strategic locations. The eighth personnel deployed for the subject’s safety would be instrumental in screening each person who ever is willing to meet the subject. (Lamb, 2004) Court Security This is the important aspect of the planning and the personnel should always be on their high alert. For that reason it is important to have complete physical protection all the while. There should be a human cordon of security personnel during the passage from parking space to court room and back as this is the area where the subject would be most vulnerable as the demonstrators would have opportunity to come in close proximity with the subject. At the courtroom too the human cordon would be applied with 4 of the personnel always encircling the subject. The remaining 2 would stand at a distance keeping a keen eye on the proceedings and scanning the crowd at the courtroom and always ready to intervene if needed. (Fletcher, 2005) Conclusion These are the Security arrangements that I will like to have at the principals estate because of threats on his life, but the principal will not face any difficulty while he likes to speak his mind to everyone, including and especially the press. The liklihood of being in a collision any year is only 1/5 people.The chances of suffering an injury that is serious enough to disable you is 1/83 people (Kenel, 8) . As you can see risk is always very high and should never be forgot. One huge risk in driving is to be under the influence of an illegal substance or drug. There are many kinds of drugs that affect you perception and driving skills. They include Over the counter drugs, Prescription drugs, Depressants, Stimulants, Hallucinogens and Narcotics. Over the cou... ...hod. Whichever way feels most comfortable to you. Also when turning use blinkers and slow down a bit (Handbook). Tracking is how you keep your car on a chosen path. Track smoothly while going fast to prevent accidents (Handbook). The final two things to knowing how to drive is braking and stopping. In bracking you should know the amount of pressure needed to brake the car your driving. Also you always want to keep an adequate braking distance between you and the car ahead (Kenel 120). When stopping check for following cars, apply firm, steady pressure on the brakes and come to a complete stop. Leave the transmission in drive if you plan to move ahead in the next minute (Kenel 121). That pretty much wraps up my how to drive instructions. Netflix Business Risks Essay

For a low monthly price Netflix allows their customers not only to streamline videos on their mobile devices and computers but also choose from a wide variety of DVD’s. This allows for the consumer to watch as much which is beneficial for someone that has a busy schedule and would like to go back and catch up where they left off. As with every business there are risks associated with the everyday operations and I will go into detail as to what the risks are that Netflix has encountered. Business Risk I was a Netflix customer back in 2010 and I was pleased with the low monthly rate associated with a Netflix membership. This option was wonderful with a houseful of children that had different likes in what they watched everyone was pleased. As I carefully monitored my monthly bank statements the low price was at a constant rate up until the middle of July 2011. My monthly fee of $8.50 went up to $16.00 which nearly doubled. More than doubled. I made the honest mistake of not taking into consideration the economic downturn and what risks were associated with such a good deal. As the saying goes, if it is too good to be true it must be. With a household of 7 I had to outweigh the pros and cons of paying an additional $8.00 a month. While comparing the previous membership price along with the new membership price there was no return on the company’s part. I was still able to view movies via streaming online as well as DVD’s in the mail. So why did the the price jump? Pogue (2011) states, â€Å"This, as you can imagine, is not a popular decision. This isn’t a cost-of-living increase. This isn’t inflation. It’s a 60 percent overnight price increase — that gives you nothing new in return.† Not only was I the only irate customer. Netflix felt this chain of reaction across the globe, the consequence of a 60% price increased caused Netflix to lose 800,000 customers in their third quarter. Operational Risks Netflix’s Chief Executive Office Reed Hastings made the decision in splitting Netflix into two separate companies. One of the companies will be specifically for streaming movies on demand and the other company will be called Qwikster specifically for the DVD business. Blodget (2011) states, â€Å"And we can also certainly understand why, from the company’s perspective, it makes sense to split the DVD and streaming businesses into two separate companies: They’re different businesses, with different cost structures and different delivery, marketing, licensing, and management challenges, and they will be easier to run better if they’re managed separately.† Split in Two. It only makes sense to create two companies that would help them focus on their main objective. Since Qwikster will be for the dvd section library they have to take into consideration the costs of shipping out a dvd, the quantity of inventory in the warehouse as well as inventory turnov er. Online streaming does not the same costs associated since the consumer is just a click away from watching at their convenience. Consumers are sometimes forced in choosing the DVD’s because as I have experienced myself some of the older and newer versions of movies are not available to stream online. For example, Willow was an all-time favorite of mine during my childhood, while checking the streaming library I came across the movie but once I had clicked on the title it showed it was only available via DVD. I have a very bad habit in returning the Netflix dvd given there are no additional shipping costs associated with the dvd, but the downfall for Netflix is that there is one less dvd out in the world and the inventory won’t be replenished until I return this movie. Financial Risk Netflix domestic online streaming has a committed amount of customers while domestic dvd are hit the worst. Netflix membership plans include $8.00 a month for unlimited streaming, for an additional $8.00 more a month customers can add unlimited DVD’s, and if the consumer is interested in Blu-ray disks then they would add an additional $2.00 on top of dvd price bringing it up to $10.00 for Blu-ray’s. Hurley (2012) states, â€Å"Nevertheless, gross, operating, and net income margins have been sliding steadily and substantially for several years. Moreover, Netflix continues to rely on subscriptions to its DVD’s-by-mail service to prop up net income. Although management officially altered corporate strategy to place emphasis  on streaming services rather than DVD-by-mail services and there are more than twice as many streaming subscriptions as by-mail subscriptions.† Strong Force. In December 2012 it was announced that both Disney (DIS) and Netflix (NFLX) announced a deal that would allow Disney shows and movies to be available to only Netflix’s subscribers. The result of this announcement resulted in Netflix stock rise to 15%. This is great news for consumers like me who is a Disney fanatic, now I will have a reason to stay with Netflix so that I can watch Disney movies with an unlimited amount of time. Conclusion When the price increase occurred back in 2011, I did cancel my membership because I was still feeling the economic downturn in my household. I would rather use that $18.00 towards filling up my gas tank rather than watch TV, in my eyes needs are more important than wants in my household. In mid-2012 I had a career change that resulted in a higher income. I now had a little extra play money to apply to a want that I once had and since Netflix allowed my children to be satisfied and allowed for some quiet time on my end, I went ahead and renewed my subscription. Transitioning From High School Life - 843 Words

In the beginning I was really nervous about transitioning from high school life to college life. What everyone says is true; college is a whole different world when compared to high school. That includes the people around me, and the new responsibilities I had to take on. When I was told that I had to take a cornerstone class I was not happy that I had to pay for a class that had nothing to do with my major. Turns out this class was the most helpful class to help a freshman tune into the college life and learn more about the school and what it offers. Without this class I wouldn’t have went to any of the activities that FSW held or even know my way around the campus. The GPS assignment really helps get students involved and makes them feel more connected with the school. What I really took from this class was the lessons on time management, career planning and critical thinking. Time management became extremely crucial to me because I was juggling a job and school along with deadlines and other important dates throughout the term. It wasn’t until about a month into the term that I realized I needed to fix the way I was utilizing my time. History of the Domestication of Donkeys

The modern domestic donkey (Equus asinus) was bred from the wild African ass (E. africanus) in northeastern Africa during the predynastic period of Egypt, about 6,000 years ago. Two wild ass subspecies are thought to have had a role in the development of the modern donkey: the Nubian ass (Equus africanus africanus) and the Somali ass (E. africanus somaliensis), although recent mtDNA analysis suggests that only the Nubian ass contributed genetically to the domestic donkey. Both of these asses are still alive today, but both are listed as critically endangered on the IUCN Red List. The donkeys relationship with the Egyptian civilization is well-documented. For example, murals in the tomb of the New Kingdom pharaoh Tutankhamun illustrate nobles participating in a wild ass hunt. However, the real importance of the donkey relates to its use as a pack animal. Donkeys are desert-adapted and can carry heavy loads through arid lands allowing pastoralists to move their households with their herds. In addition, donkeys proved ideal for the transport of food and trade goods throughout Africa and Asia. Domestic Donkeys and Archaeology Archaeological evidence used to identify domesticated donkeys includes changes in body morphology. Domestic donkeys are smaller than wild ones, and, in particular, they have smaller and less robust metacarpals (foot bones). In addition, donkey burials have been noted at some sites; such burials likely reflect the value of trusted domestic animals. Pathological evidence of damage to spinal columns resulting from donkeys use (maybe overuse) as pack animals is also seen on domestic donkeys, a situation not thought likely on their wild progenitors. The earliest domesticated donkey bones identified archaeologically date to 4600-4000 BC, at the site of El-Omari, a predynastic Maadi site in Upper Egypt near Cairo. Articulated donkey skeletons have been found buried in special tombs within the cemeteries of several predynastic sites, including Abydos (ca. 3000 BC) and Tarkhan (ca. 2850 BC). Donkey bones also have been discovered at sites in Syria, Iran, and Iraq between 2800-2500 BC. The site of Uan Muhuggiag in Libya has domestic donkey bones dated to ~3000 years ago. Domestic Donkeys at Abydos A 2008 study (Rossel et al.) examined 10 donkey skeletons buried at the Predynastic site of Abydos (about ca 3000 BC). The burials were in three purposefully constructed brick tombs adjacent to the cult enclosure of an early (so far unnamed) Egyptian king. The donkey tombs lacked grave goods and in fact, only contained articulated donkey skeletons. An analysis of the skeletons and comparison with modern and ancient animals revealed that the donkeys had been used as beasts of burden, evidenced by signs of strain on their vertebral bones. In addition, the body morphology of the donkeys was midway between wild asses and modern donkeys, leading researchers to argue that the domestication process was not complete by the end of the predynastic period, but instead continued as a slow process over periods of several centuries. Donkey DNA DNA sequencing of ancient, historic and modern samples of donkeys throughout northeastern Africa was reported (Kimura et al) in 2010, including data from the site of Uan Muhuggiag in Libya. This study suggests that domestic donkeys are derived solely from the Nubian wild ass. Results of the testing demonstrate that Nubian and Somali wild asses have distinct mitochondrial DNA sequences. Historic domestic donkeys appear to be genetically identical to Nubian wild asses, suggesting that modern Nubian wild asses are actually survivors of previously domesticated animals. Further, it seems likely that wild asses were domesticated several times, by cattle herders perhaps beginning as long ago as 8900-8400 calibrated years ago cal BP. Interbreeding between wild and domestic asses (called introgression) is likely to have continued throughout the domestication process. However, Bronze Age Egyptian asses (ca 3000 BC at Abydos) were morphologically wild, suggesting either that the process was a long slow one, or that wild asses had characteristics that were favored over domestic ones for some activities. Film and Book The Striped Pajamas by John Boyne Essay

Sins of the Father The movie ‘Boy in the Striped Pajamas’, based on the book by John Boyne, isn’t exactly a feel-good film, but it is an awesome representation of the existence of good and evil, and the responsibility we have as human beings to distinguish between the two; for it is responsibility that distinguishes us from every other being. In my opinion, this is an important, life-changing film, with a significant message, and should be seen by all. The movie is told from the point of view of eight year old Bruno whose innate sense of morality and justice ultimately makes him the fallen hero of the story. The premise of the movie focuses on a friendship that develops between Bruno and Shmuel, also eight, and a victim of the†¦show more content†¦Standing up on the swing to get a better view, he falls off of the swing and scrapes his knee. Pavel, runs to help Bruno, takes him inside and bandages his knee. Pavel, assuring Bruno that he will be just fine , sits down and begins to peel potatoes. Bruno then replies How should you know, you’re not a doctor, you’re a farmer. Pavel responds, â€Å"I was a doctor before coming here†. Bruno is confused why the man would give up being a doctor to work on the farm and peel potatoes. Later that week, Bruno sneaks out and finds a door leading to a shed; he opens the window inside and gains the freedom he has been longing for. Bruno begins his exploration of the woods outside the compound. He runs quite a ways until he stumbles upon a large barbed-wire fence surrounding the farm. This is where he and Shmuel, the boy in the stripped pajamas, meet for the first time. Although separated by a fence, the boys talk and joke and get to know each other. A whistle blows and Shmuel must go, but the new friends say they hope to meet again soon. As weeks go by, Bruno continues to sneak away from the compound and the two new friends meet time and again. Bruno usually brings snacks and Shmuel speedily eats what he is given. Bruno is very curious about his new friend and continues to ask him questions about his life on the farm; he asks why they wear pajamas all day, and what the numbers on them mean.
